Common-Law: By definition, a common law partner is a person with whom a taxpayer or resident lives in a conjugal relationship and at least one of the following conditions are met which is either that the parties have cohabited with one another for the previous 12 months or the person is the parent of a taxpayer’s child. The length of cohabitation period may vary by each province. Married: The ordinary definition in which two people legally unite in marriage.

In Toronto, Canada (and Canada in general), marriage comes with several legal and financial benefits provided by the government. Here are some key advantages:

  1. Tax Benefits Spousal Tax Credit: If one spouse has little to no income, the higher-earning spouse may claim a tax credit for them. Income Splitting: Some tax benefits allow couples to split income (such as pension income splitting) to reduce overall taxes. RRSP Contributions: You can contribute to a spousal RRSP to lower taxable income and help your partner save for retirement.

  2. Inheritance & Estate Benefits Automatic Inheritance: If a spouse dies without a will, the surviving spouse is entitled to a portion of their estate. No Probate Fees on Certain Transfers: Assets such as real estate and bank accounts can transfer to the surviving spouse without going through probate (saving money and time). Tax-Free Transfer of Assets: Spouses can transfer assets to each other tax-free (e.g., property or investments).

  3. Health & Employment Benefits Extended Health Benefits: Many employer-sponsored health plans allow spouses to be covered under the same plan. Sick Leave & Caregiver Benefits: If your spouse is ill, you may qualify for caregiver benefits through Employment Insurance (EI).

  4. Immigration & Sponsorship Spousal Sponsorship for Permanent Residency: If one spouse is a Canadian citizen or permanent resident, they can sponsor their partner for immigration. Easier Work Permits for Spouses: If one spouse is on a work or study permit, the other may be eligible for an open work permit.

  5. Child Benefits & Family Support

✅ Canada Child Benefit (CCB)

A tax-free monthly payment for parents to help with the cost of raising children under 18. Amount depends on family income and number of children. Higher payments for lower-income families.

✅ Ontario Child Benefit (OCB)

Additional support for low- to moderate-income families in Ontario. Paid along with the CCB.

✅ Child Disability Benefit (CDB)

Extra financial help for families with children who have a disability and qualify for the Disability Tax Credit.

✅ Canada Dental Benefit (Temporary until 2025)

Helps lower-income families cover dental care costs for children under 12.

✅ Canada Learning Bond (CLB) & Registered Education Savings Plan (RESP)

The government contributes up to $2,000 for a child’s education savings if the family has a low income (even if no money is contributed by parents).

  1. Benefits for Spouses & Adults

✅ GST/HST Credit

A tax-free payment every 3 months to help lower-income families with sales tax expenses. Based on household income (may be reduced if a spouse has a higher income).

✅ Ontario Trillium Benefit (OTB)

Helps with energy, property tax, and sales tax costs. Includes the Ontario Sales Tax Credit, Energy & Property Tax Credit, and Northern Ontario Energy Credit.

✅ Employment Insurance (EI) Benefits for Parents & Caregivers

Maternity & Parental Leave: Up to 18 months of paid leave for new parents. Caregiver Benefits: Financial support for those caring for a critically ill family member (child or adult).

✅ Spousal Allowance (for Low-Income Seniors)

If one spouse is eligible for the Guaranteed Income Supplement (GIS) and the other is 60-64 years old, they may receive additional monthly payments.

✅ Old Age Security (OAS) & Canada Pension Plan (CPP) Survivor Benefits

Provides financial support to spouses or dependents when a partner passes away.

✅ Ontario Works (OW)

Provides financial and employment assistance for families in need.

✅ Ontario Disability Support Program (ODSP)

Monthly financial support for individuals with disabilities and their families.

✅ Canada Housing Benefits & Rent Assistance

Programs like the Canada-Ontario Housing Benefit (COHB) help families with rent costs.

Support for Students1. Financial Aid

Ontario Student Assistance Program (OSAP): Provides grants (free money) and loans (repayable) based on financial need. Available for full-time and part-time students. Ontario Tuition Grants and Rebates: Some low-income students may qualify for tuition grants that reduce their education costs. Repayment Assistance Plan (RAP): Helps graduates manage OSAP loan payments based on income levels. 2. Scholarships & Grants Ontario Graduate Scholarships (OGS): Merit-based funding for master’s and doctoral students. Indigenous Student Bursaries: Financial support for Indigenous students through various institutions and programs. Bursaries for Students with Disabilities (BSWD) & Canada Student Grant for Services and Equipment (CSG-DSE): Help cover disability-related education costs. 3. Subsidized Programs & Work Opportunities Student Work Placement Program (SWPP): Federal funding that helps employers hire post-secondary students in paid work placements. Canada Summer Jobs Program: Offers wage subsidies for employers who hire students for summer work. Co-operative Education Tax Credit: Provides businesses with tax incentives to hire co-op students. 4. Post-Secondary Institution Supports Many Ontario colleges and universities offer emergency bursaries, food banks, and mental health services for students in need.
